This agreement outlines the terms and conditions of KaiVitae’s FoodKey Diabetes Cure Guarantee. By participating in this program, the user agrees to comply with the following conditions:

While using FoodKey, all users should continue to follow their Physician's treatment advice until all biomarkers are normal.

Guarantee Terms and Conditions

​

1. Continuous Food Tracking:

   • The user must take an image of all food and beverages consumed during the program period.

2. Food Identification:

   • If KaiVitae’s app does not automatically or correctly recognize a food item, the user is required to manually identify it.

3. FoodKey Score Requirement:

   • The user must maintain an average FoodKey Score of 70 or higher for a continuous period of 9 months.

4. Definition of Diabetes Cure:

   • The user is considered cured if they meet the following criteria:

     • They are no longer taking any diabetes medications.

     • Their HbA1c biomarker is below 6.5, as verified by appropriate medical testing.

Guarantee Outcome

If the user fulfills all the above conditions but does not achieve the definition of diabetes cure as outlined in Condition 4, KaiVitae will refund $108 to the user. Credits will be issued for each of the nine individual credit card payments of $12, resulting in a total refund amount of $108.

Additionally, KaiVitae will continue to guarantee that diabetes type 2 will not return for 

a period of 5 years if the user continues to use FoodKey, tracks their food intake as in 

number (1) above and maintains a monthly average FoodKey Score above 70 as in (3) 

above.

 

Additional Terms

​

1. Users who claim and receive the $108 rebate will lose access to the KaiVitae FoodKey application when their money is refunded.

2. KaiVitae reserves the right to request evidence of compliance with the above terms, including but not limited to:

   • Proof of food tracking (KaiVitae tracks this automatically on FoodKey servers and uses algorithms to determine compliance)

   • Verification of FoodKey Scores (KaiVitae continuously tracks this score to provide coaching feedback)

   • Medical documentation of HbA1c levels.
